DGTX held by the Digitex “treasury.”
The court ultimately found the CFTC sufficiently pleaded attempted manipulation
of a commodity in interstate commerce and other charges.
The CFTC cautions that orders requiring payment of funds to victims may not
result in the recovery of any money lost because wrongdoers may not have sufficient
funds or assets. The CFTC will continue to fight vigorously for the protection of
customers and to ensure the wrongdoers are held accountable.

美国商品期货交易委员会（CFTC）宣布，其已在美国纽约南区地方法院对
Alexander Mashinsky 和 Celsius Network, LLC 提起诉讼。诉状指控被告在其基于
数字资产的金融平台运营中存在欺诈和重大虚假陈述，该平台吹嘘其高利润和安
全性，诱导客户在平台存入数字资产商品。
诉状还指控 Celsius 未经注册以商品基金管理人（CPO）名义开展业务，
Mashinsky 未经注册以商品基金管理人业务代表（AP）名义开展业务。CFTC 和
Celsius 同意通过禁止公司再次违反《美国商品交易法》（CEA）的永久禁令了结
诉讼。
执法主任 Ian McGinley 表示：“随着公司和个人利用数字资产商品不断开发
新产品和服务，他们必须遵守禁止市场欺诈的长期既定规则，并遵守《美国商品
交易法》的注册要求。《美国商品交易法》的基本原则是保护客户和市场诚信。
