多人,集资超过 600 万美元,并成立了一个名为“神佑加密”(Blessings of God
Thru Crypto)的商品基金。被告谎称,基金的资金是安全可控且预期收益极高的,
该资金将在“Apex 交易平台”上交易“加密货币期货合约”,并由一个仅知其
名为“Coach Wendy”的人提供交易建议。指控进一步称,被告利用他们通过房
地产业务发展起来的个人和业务关系,以说服受害者相信该基金计划是合法的。
据称,超过 400 万美元的基金资金被投入到“Apex 交易平台”,但实际上很
快被转移到了超出被告控制的各种数字钱包中,现已无法追回。此外,被告挪用
了大约 100 万美元的资金来偿还其债务、购买昂贵珠宝和一辆全地形车等物品。
为了使计划能尽可能长地存续,被告挪用了剩余的资金来进行类似庞氏计划的支
付。
CFTC 在此提醒,因为违法行为人可能没有足够的资金或资产,要求向受害
者支付资金的命令可能不能够追回全部的损失。CFTC 将继续为保护客户和确保
追究违法行为人的责任而积极努力。
CFTC Charges Tennessee Husband and Wife Realtors for Operating a $6 Million
Digital Assets Commodity Pool Scheme(2023/7/25)
The Commodity Futures Trading Commission today announced it filed a
complaint in the U.S. District Court for the Middle District of Tennessee against
Michael and Amanda Griffis of Clarksville, Tennessee. The complaint charges the
defendants with defrauding over 100 people across the U.S. and failing to register with
the CFTC in connection with a multi-million dollar commodity pool scheme they
operated from approximately July 2022 through January 2023.
In its continuing litigation, the CFTC seeks restitution to defrauded pool
participants, civil monetary penalties, permanent trading and registration bans, and a
permanent injunction against further violations of the Commodity Exchange Act (CEA)
and CFTC regulations, as charged.
“As alleged, the defendants promised pool participants a safe investment in
digital asset futures contracts with huge profit potential. The promises were
