The Guidelines will be translated into the official languages of the EU and

published on ESMA’s website. The publication of the translations will trigger a two-

month period during which national competent authorities must notify ESMA whether

they comply or intend to comply with the Guidelines. The Guidelines will apply two

months after the date of the publication on ESMA’s website in all EU official languages.

9. 欧盟证券与市场管理局就交易报告库的持仓计算征求意见（2023 年 3 月 28 日）

欧盟证券与市场管理局（ESMA，欧盟证券市场的监管者）已发起《欧洲市

场基础设施监管条例》（EMIR）项下交易报告库（TRs）持仓计算指南修订工作

的征求意见。

征求意见中，ESMA 正在向市场参与者，特别是交易报告库和能够获取 EMIR

数据的机构征求意见，以了解 EMIR Refit 标准下，能够在多大程度上提高交易

报告库持仓计算的一致性，包括：

 需要使用的数据范围；

 计算时间，以及

 计算方法。

该指南是针对交易报告库的，旨在确保他们以统一的方式计算衍生品的持仓，

并符合 EMIR Refit 下所修订的技术标准。
