2020 年 1 月，英国（UK）和欧盟最终确定了《大不列颠及北爱尔兰联合王
国退出欧洲联盟及欧洲原子能共同体协定》（Agreement on the withdrawal of the
United Kingdom of Great Britain and Northern Ireland from the European Union and
the European Atomic Energy Community）。根据该协定，英国于 2020 年 1 月 31
正式脱欧，并进入到过渡期，该过渡期于 2020 年 12 月 31 日结束。因此，位于
英国的 MTFs 和 OTFs 已从欧盟根据 CEA 第 5h(g)规定获得的豁免行政令所涵盖
的合格 MTFs 和 OTFs 名单中除名。
2019 年 2 月 25 日，CFTC 与英格兰银行（包括审慎监管局和英国金融行为
监管局）联合发表声明，为英美之间的衍生品交易和清算活动的连续性提供了监
管上的确定性。在联合声明中，CFTC 表示其将重制欧盟替代性合规和豁免相关
的行政令，其中包括根据 CEA 第 5h(g)节作出的行政令。
CFTC 工作人员于 2021 年 11 月 17 日发布了 CFTC 工作人员信函 21-24，保
持了欧盟豁免行政令在英国脱欧过渡期结束后对英国 MTFs 和 OTFs 的适用，与
此同时，CFTC 根据 CEA 第 5h(g)节的规定开展对英国 MTFs 和 OTFs 作出决定
的工作。CFTC 将继续保持欧盟豁免行政令对英国 MTFs 和 OTFs 的适用，直到
根据 CEA 第 5h(g)节完成对英国 MTFs 和 OTFs 做出决定。
虽然欧盟豁免令已不包含 CFTC 工作人员信函 21-24 附录 A 中所列的英国
MTFs 和 OTFs，但他们仍属于 CFTC 工作人员信函 21-24 中不采取行动的对象。
