5. 美国商品期货交易委员会命令 tpSEF 就其在互换交易设施上执行交叉盘交易
时违反 15 秒延迟规则的行为支付罚金 85 万美元（2022 年 9 月 29 日）
美国商品期货交易委员会（CFTC）签发行政令对 tpSEF, Inc.（注册互换交
易设施，SEF）未能遵守 CFTC 关于 SEF 订单簿上某些交易要求的 15 秒延迟规
定的行为进行立案并同时达成和解。
具体而言，CFTC 联邦法规要求，对于预先安排或预先协商的交易指令且将
导致两客户指令相匹配或者，经纪商或交易商作为客户交易指令的对手方，SEF
必须要求经纪商或交易商在下单时至少间隔 15 秒。tpSEf 既未按该要求执行，也
并未严格执行其自有的 15 秒延迟规则。
行政令要求 tpSEF 停止违反 CFTC 时间延迟规定的行为，支付 85 万美元民
事罚款，并遵守承诺，审查从 2020 年 8 月至今在 SEF 上执行的所有交易是否符
合其制定的有关 15 秒延迟要求的规定，并评估其建立的旨在阻止和发现将来违
