5. 中国证监会就《衍生品交易监督管理办法（二次征求意见稿）》公开征求意见

（2023 年 11 月 17 日）

为贯彻落实《期货和衍生品法》，促进衍生品市场规范健康发展，支持服务

实体经济，防范化解金融风险，打击违法违规和规避监管行为，维护市场稳定，

前期证监会在总结实践经验的基础上，起草形成了《衍生品交易监督管理办法（征

求意见稿）》，并于 2023 年 3 月 17 日至 4 月 16 日期间向社会公开征求意见。之

后证监会对公众意见进行了认真研究，并召开多场座谈会听取行业建议，对征求

意见稿进行了修改完善，形成了《衍生品交易监督管理办法（二次征求意见稿）》

（以下简称本办法）。修改完善后的办法共八章，50 条，主要对衍生品交易和结

算、禁止的交易行为、交易者、衍生品经营机构、衍生品交易场所、衍生品结算

机构、衍生品交易报告库、衍生品行业协会等进行了规范。为更好贯彻民主立法、

开门立法原则，证监会就本办法及起草说明再次向社会公开征求意见。

prevent and resolve financial risks, combat illegal and regulatory evasion, and to
