counterparties (NFCs) acting as clearing members and public guarantees for all types

of counterparties will continue to be temporarily eligible by central counterparties

(CCPs) in order to avoid potential disruption during the upcoming cold season.

The temporary measures set out in ESMA’s Final Report were adopted during the

height of the energy crisis to alleviate the liquidity pressure on NFCs active on gas and

electricity regulated markets that clear in EU-based CCPs.

Next steps

The Final Report has been sent to the European Commission for endorsement and

will be subject to a scrutiny procedure by the European Parliament and the Council.

欧盟证券与市场管理局（ESMA，欧盟证券市场的监管者）根据 2022 年收

集的数据进行了首次年度评估。通过评估，ESMA 确定有两家数据报告服务提供

商（DRSP）超过了豁免阈值。

如果上述两家数据报告服务提供商在明年再次超过规定阈值，则其将从

2025 年 6 月 1 日起接受 ESMA 的直接监管。在此之前，它们将在 2024 年继续由

各自的成员国监管机构（NCAs）监管。

ESMA 经授权，有责任对欧盟市场的核准公布安排（APA）和核准报告机制

（ARM）的相关性进行年度评估。《授权法案》（DA）详细了确定符合豁免条件
