                        案件背景



                        判令认定,大约从 2011 年 7 月至 2013 年 7 月,Vorley 和 Chanu 在受雇于 A


                   银行期间,分别为 COMEX 黄金、白银、铂金或钯金期货合约下达了他们希望


                   得到执行的订单(真实订单 genuine orders),并为相同合约的市场相反方向下

                   了他们打算在执行前取消的订单(幌骗订单 spoof orders)。Vorley 和 Chanu 在


                   发出幌骗订单时,故意或不计后果地向市场参与者发出更大的供应或需求信号,


                   以造成价格将上涨或下跌的假象,并诱使市场参与者同他们在市场相反方向发出


                   较小的真实订单上进行交易。判令最终认定,被告行为构成了幌骗(spoofing)


                   和欺诈性或操纵性计划,违反了 CEA 和 CFTC 监管规定。


                   Federal Court Orders Precious Metals Traders to Pay Penalties and Imposes

                   Trading Bans for Spoofing and Engaging in a Deceptive or Manipulative Scheme

                        The Commodity Futures Trading Commission today announced that Judge

                   Steven C. Seeger of the U.S. District Court for the Northern District of Illinois issued

                   final judgments and consent orders against James Vorley and Cedric Chanu, former

                   precious metals traders, for spoofing and engaging in a deceptive or manipulative

                   scheme, in violation of the Commodity Exchange Act (CEA) and CFTC regulations.


                        The orders impose a $150,000 civil monetary penalty on each defendant, a
                   five-year ban from trading on or subject to the rules of any registered entity and from

                   registering with the CFTC in any capacity, and require each to cease and desist from

                   violating the CEA, as charged. The orders resolve the CFTC’s complaint filed against
