美国商品期货交易委员会（CFTC）公告，4 月 15 日，美国威斯康星州西区
地方法院陪审团作出裁决，认定 Edward S. Walczak 应当对其违反《美国商品交
易法》（CEA）第 4o(1)(B)节，欺诈或欺骗投资者、潜在投资者或投资顾问的行
为承担责任。
2020 年 1 月 27 日，CFTC 对 Walczak 提起诉讼，指控其谎报了自己在 Catalyst
对冲期货策略基金中管理风险的方式。经过为期 5 天的审理，Walczak 最终被判
有罪。陪审团认为，Walczak 不对违反 CEA 第 4o(1)(A)和 6(c)(1)节以及 CFTC
监管规定第 180.1 节的行为承担责任。关于处罚的进一步程序将随后进行。
CFTC 代理执法主任 Vincent McGonagle 表示：“真实、准确的信息披露对投
资者保护而言至关重要。正如我们在本案一开始时所说，CFTC 将致力于追究那
些谎报产品投资风险的人的责任。”
在审理中，CFTC 的案件与美国证券交易委员会（SEC）针对 Walczak 的同

Manager Found Liable for Making False or Misleading Statements （2022/4/19）
The Commodity Futures Trading Commission today announced that on April 15,
a jury in the U.S. District Court in the Western District of Wisconsin issued a verdict
finding Edward S. Walczak liable for engaging in conduct that operated as a fraud or
deceit upon investors, potential investors, or investment advisors, in violation of
Section 4o(1)(B) of the Commodity Exchange Act (CEA).
The verdict was obtained after a 5-day trial that was the culmination of an action
brought by the CFTC against Walczak on January 27, 2020, that alleged he
