1. 证监会、财政部联合发布《关于证券违法行为人财产优先用于承担民事赔偿

责任有关事项的规定》（2022 年 7 月 27 日）

为了落实中央巡视反馈意见，践行以人民为中心的发展思想，推动民事赔偿

责任优先原则落地，切实保护投资者合法权益，证监会、财政部联合制定了《关

于证券违法行为人财产优先用于承担民事赔偿责任有关事项的规定》，共十四条，

主要包括申请主体、申请期限、申请材料、办理流程等内容，明确了违法行为人

所缴纳的行政罚没款用于承担民事赔偿责任的具体工作机制。自公布之日起施行。

People’s Republic of China Jointly Issue the Provisions on Matters Concerning

the Preferential Use of Securities Law Violators’ Property for Bearing Civil

Compensation Liability (2022/7/27)

In order to implement the feedback from the CPC Central Committee on

inspections, practice the people-centered development thoughts, promote the

implementation of the principle of the prioritization of civil-compensation liabilities,

and effectively protect the lawful rights and interests of investors, the China Securities

Regulatory Commission and the Ministry of Finance have jointly issued the

Provisions on Matters Concerning the Preferential Use of Securities Law Violators’

Property for Bearing Civil Compensation Liability (the "Provisions"). The Provisions

consists of 14 articles, mainly covering the subject of application, application period,

application materials, application procedures and other contents, and specifies the

mechanism under which a violator’s administrative fine and confiscated money will
be used for assuming civil compensation liabilities. The Provisions shall come into

force on the date of publication.
