DMO has determined that Victoria University has not operated its market in
compliance with the terms of the letter and as a result has withdrawn it. As stated in

the withdrawal letter issued today, to the extent that Victoria University is operating

any contract market in a manner consistent with each of the terms and conditions

provided in CFTC Letter 14-130, all related and remaining listed contracts and

positions comprising all associated open interest in such market should be closed out

and/or liquidated no later than 11:59 p.m. (EDT) on February 15, 2023.

美国商品期货交易委员会（CFTC）在美国内华达州地方法院对内华达州拉

斯维加斯的 Daniel Shak 提起民事执法诉讼，指控其在黄金和白银期货市场存在

幌骗行为，并参与了欺诈性和操纵性计划。

在接下来的诉讼中，CFTC 要求对其处以民事罚款、没收其违法所得、禁止
其进行交易以及发布永久禁令以防止其再次出现违反联邦商品法律的行为等救

济措施。

CFTC 代理执法主任 Gretchen Lowe 表示：“此次指控再次表明，CFTC 将

在法律允许的最大限度内起诉有可能破坏我们市场诚信的违法行为。”

案件背景

诉状称，自 2015 年 2 月至 2018 年 3 月，当 Shak 在纽约商品交易所下单从

事黄金和白银期货合约交易时，多次通过幌骗手段（意图在成交前撤单的买卖报

单）从事操纵性或欺诈性行为。数百次，Shak 挂出黄金或白银的大额订单（意

图在成交前撤单），同时通过黄金或白银期货市场反向下单。通过挂出幌骗报单，

Shak 故意或不计后果地发出了市场供需增加的虚假信号，旨在诱骗市场参与者

执行相反方向的报单，而实际上他希望这些报单得到执行。Shak 的幌骗报单使
