12. 欧洲证券与市场管理局更新对美国中央对手方的认可申请（2022 年 6 月 28

日）

欧洲证券与市场管理局（ESMA，欧盟证券市场的监管者）宣布，认可两家

在美国设立的中央对手方（CCPs）成为《欧盟市场基础设施监管条例》（EMIR）

下的第一层 级中央对手方，即固定收益清 算机构（Fixed Income Clearing

Corporation，FICC）和期权清算公司（Options Clearing Corporation，OCC）。

2022 年 6 月 27 日，ESMA 首次认可由美国证券交易委员会（SEC）批准许

可并监管的 FICC，以及由 SEC 和美国商品期货交易委员会（CFTC）共同批准

许可并监管的 OCC 为 EMIR 第 25 条规定的第一层级中央对手方。此前，欧盟委

员会于 2022 年 4 月 4 日通过了对委员会实施决定（EU）2021/85、委员会实施

决定（EU）2022/552 的修正案，该修订涉及由 SEC 批准许可并监管的美国中央

对手方的监管框架与 EMIR 要求具有等效性。

被认可的第三国中央对手方（TC-CCPs）的具体名单公布于 ESMA 官方网

12. ESMA Updates on Applications for Recognition from U.S.- based CCPs

The European Securities and Markets Authority (ESMA), the EU’s securities

markets regulator, has announced its recognition of two central counterparties (CCPs)

established in the United States (U.S.) as Tier 1 CCPs under the European Market

Infrastructure Regulation (EMIR). These are the Fixed Income Clearing Corporation

(FICC) and the Options Clearing Corporation (OCC).

ESMA, on 27 June 2022, recognised, for the first time, both FICC, which is

authorised and supervised by the U.S. Securities and Exchange Commission (SEC),
and OCC, which is jointly authorised and supervised by the SEC and the U.S.

Commodity Futures Trading Commission (CFTC), as Tier 1 CCPs under Article 25 of
