The divisions will not recommend the CFTC initiate an enforcement action
against either entity or their participants for failure to comply with certain
swap-related recordkeeping requirements and for failure to report to swap data
repositories data associated with binary option transactions and variable payout
contract transactions executed on or subject to the rules of QCX LLC and cleared
through QC Clearing LLC, subject to the terms of the no-action letter.
The no-action letter applies only in narrow circumstances and is comparable to
no-action letters issued for other similarly situated designated contract markets and
derivatives clearing organizations.

冲刺计划涵盖 10 家机构；应用最新自我报告与合作矩阵
美国商品期货交易委员会（CFTC）同时发布六项行政令，对 10 家机构重大
合规问题提起指控并达成和解，总计处以 8,325,000 美元民事罚款。这些行政令
源于代理主席 Caroline D. Pham 推行的执法冲刺计划。
根据该计划，符合条件的机构向执法部提交整改方案，并参照过去十年类似
案例及执法部《自我报告、合作与整改意见》，提出了合理的和解方案。此次行
动的适用范围仅限于合规违规相关执法事项，例如记录保存、信息报告等合规类
违规行为，不包含欺诈、损害客户利益或市场滥用等情形。
每家机构均已完成或即将完成整改，并同意停止违反《美国商品交易法》及
CFTC 联邦法规的行为（如指控所述）。
代理主席 Pham 表示：“三月在国际期货业协会博卡会议（FIA Boca）上宣
布执法冲刺计划时，我曾对因运营或技术合规等无实质危害的违规行为导致的执
