14. 欧盟证券与市场管理局发布关于牌照通行新修订技术标准的报告（2023 年 7
月 11 日）

欧盟证券与市场管理局（ESMA，欧盟金融市场与证券监管者），发布了关

于审查《欧盟金融市场工具指引 II》 （ MiFID II） 第 34 条中牌照通行技术标准的

最终报告。

ESMA 提议对现行的监管技术标准（RTS）和实施技术标准（ITS）进行针对

性修订，将新的信息要求添加到投资公司在牌照通行阶段必须提供的详细信息列

表中。

新的投资服务和活动开展通知也将会向各成员国相关监管机构（NCAs）提

供关于公司已安排或现进行的跨境活动的额外信息。ESMA 和 NCAs 发现，欧盟

各国的投资公司为散户提供的跨境服务呈现持续上升趋势。

该提议对消费者和投资公司都有明显好处，因为其促进竞争，增加了散户投

资者的选择。由于跨境活动可能产生破坏投资者信心的风险，从长远来看，该风

险会阻碍单一市场的发展，这要求 NCAs 加强监管重点与合作。

ESMA 已向欧盟委员会（EC）提交了该最终报告，如果欧盟委员会决定继续

该审查，ESMA 将提供进一步的建议和技术指导。

ESMA Publishes Final Report on Revised Technical Standards for Passporting

(2023/7/11)

The European Securities and Markets Authority (ESMA), the EU’s financial

markets regulator and supervisor, today published its Final Report on the review of the

technical standards for passporting under Article 34 of MiFID II.

ESMA’s proposals include targeted amendments to the existing RTS and ITS that

would add new information requirements to the list of details investment firms have to
provide at the passporting stage.
