                        ESMA will consider the responses to its consultation before submitting the draft

                   RTS on authorisation and registration to the European Commission for adoption. The

                   closing date for responses from stakeholders is 31 January 2023.

                        欧洲证券与市场管理局（ESMA，欧盟证券市场的监管者）发布了一份监管

                   简报，以确保欧盟（EU）对投资公司跨境活动的监管统一。


                        欧盟内的服务自由供给依赖于母国监管机构的监管以及母国与东道国监管

                   者的合作。为此，简报包括以下几方面内容：

                          对有跨境计划的公司的批准；


                          护照通告（passport notifications）的处理及其对适用于公司的监管方法的

                           影响；


                          为开展持续性监管活动所做的安排；


                          开展持续性监管；以及


                          开展调查和检查。


                        背景


                        鉴于《欧洲金融工具市场指令Ⅱ》（MiFID II）项下欧盟内投资服务提供的

                   重要性，以及对过去出现的损害投资者利益的跨境活动情况的担忧，ESMA 监督

                   委员会决定于 2021 年启动对投资公司跨境活动监管的同行审查。
