The Commodity Futures Trading Commission’s Division of Clearing and Risk
today announced it has issued a time-limited no-action letter to Taiwan Futures
Exchange (TAIFEX).
The letter states DCR will not recommend the CFTC take enforcement action
against TAIFEX if it clears swaps for the proprietary trades of TAIFEX clearing
members that are U.S. persons or affiliates of U.S. persons without registering as a
derivatives clearing organization (DCO) as required by the Commodity Exchange Act
(CEA).
The letter is effective until the earlier of September 15, 2023, or the date on
which the CFTC exempts TAIFEX from registration as a DCO under Section 5b(h) of
the CEA.

（Bean）和 Kyle Kistner（Kistner）（以上统称为被告）的下列行为进行立案并
同时达成和解：非法提供带有杠杆和保证金的数字资产零售商品交易，从事仅限
注册期货佣金商（FCM）可开展的活动，以及未制定客户识别程序（该程序是
《银行保密法（Bank Secrecy Act）》合规程序的组成部分，是对 FCMs 的要求）。
被告从事的这些活动与一个基于区块链的去中心化软件协议有关，该协议的
功能类似于交易平台。行政令要求被告支付 25 万美元民事罚款，并停止进一步
违反《美国商品交易法》（CEA）和 CFTC 联邦法规的行为。
