4. 证监会公布《关于修改、废止部分证券期货规章的决定》（中国证券监督管
理委员会令第 202 号）（2022 年 8 月 12 日）
为贯彻落实《中华人民共和国期货和衍生品法》，中国证监会对有关证券期
货制度文件进行了清理。经过清理，中国证监会决定:
一、对 8 部规章的部分条款予以修改。
主要包括以下几个方面内容:
增加《期货和衍生品法》作为上位法依据；取消对期货经营机构从业人员的
资格管理；完善期货公司董事、监事和高级管理人员的任职条件要求；相关文字
表述的调整。
二、对 1 部规章予以废止。
《期货和衍生品法》第十二条对操纵期货市场的情形进行了列举，能够涵盖
《关于期货交易管理条例第七十条第五项“其他操纵期货交易价格行为”的规定》
的相关内容。因此，对《关于期货交易管理条例第七十条第五项“其他操纵期货
交易价格行为”的规定》予以废止。
决定自公布之日起施行。

of China, China Securities Regulatory Commission (the CSRC) has cleaned up the
securities and futures rules and decided to:
