美国商品期货交易委员会（CFTC）在两起案件中取得联邦民事罚款及交易禁令；
同时对一家未注册商品基金管理人提起诉讼
CFTC 更新以下执法动态。
CFTC 取得联邦法院判令贵金属市场幌骗交易者民事罚款及禁止交易
美国伊利诺伊州北区地方法院对纽约 Gregg Smith 和新泽西州 Michael
Nowak 签发了两项同意令，因其受雇于一家大型银行期间在贵金属期货市场进
行幌骗交易。
根据同意令，Smith 应支付 20 万美元民事罚款，并在三年内禁止在 CFTC
监管的市场交易或向 CFTC 注册。Nowak 应支付 15 万美元民事罚款，并被禁止
交易和注册六个月。二位被告还被要求停止进一步违反《美国商品交易法》中关
于禁止幌骗交易的行为。
同意令了结了 CFTC 于 2019 年 9 月提起的诉讼【见 CFTC 新闻稿第 8013-19
号】。
在相关的的刑事诉讼中，Smith 和 Nowak 被判犯有欺诈、企图操纵价格和幌
骗交易罪。2023 年 8 月，Smith 被判处两年监禁并被要求支付 5 万美元罚款，
