美国商品期货交易委员会（CFTC）市场参与者部就 CFTC 联邦法规 23.431

中互换交易商和主要互换参与者关于交易前市场中间价（Pre-Trade Mid-Market

Mark，PTMMM）的要求发布了一份不行动函。

2012 年，交易前市场中间价实施日期后不久，CFTC 首次发布了关于该要求

的不行动函，因为该要求未能提供显著的信息价值，并且带来了高昂的操作成本。

此次发布的不行动函为某些特定类型的互换（如函中所述）提供了与之前的部分

不行动函类似的不行动立场，但其适用范围并不限于此类互换。

CFTC Staff Issues No-Action Letter Regarding Pre-Trade Mid-Market Mark

The Commodity Futures Trading Commission’s Market Participants Division

today issued a no-action letter in relation to the Pre-Trade Mid-Market Mark

(PTMMM) requirement in Regulation 23.431 for swap dealers and major swap
participants.

The CFTC first issued a no-action letter regarding the PTMMM requirement in

2012, shortly after the PTMMM compliance date, because it did not provide

significant informational value and created costly operational challenges. Today’s

no-action letter provides a similar no-action position as those in certain prior

no-action letters for certain specified types of swaps, as described in the letter, but is

not limited to such types of swaps.
