1. 美国商品期货交易委员会工作人员就某些 CFTC 监管实体的隶属关系的影
响公开征求意见（2023 年 6 月 28 日）

美国商品期货交易委员会（CFTC）市场监管部、清算与风险部和市场参与

者部门的工作人员发布一份征求意见函，以更好地了解由于 CFTC 注册实体与市

场参与者的隶属关系而可能产生的潜在问题。

该征求意见函特别咨询了衍生品清算机构（DCOs）、指定合约市场（DCMs） 、

或互换执行设施（SEFs）与中介机构，如期货佣金商（FCMs），或其他市场参

与者之间的隶属关系。根据《美国商品交易法》（CEA）和 CFTC 联邦法规，衍

生品清算机构、指定合约市场、互换执行设施均有责任监督其参与者。与中介机

构或其他市场参与者的隶属关系，引起了如何履行这些监督职责的问题。这 37

个问题的征求意见函旨在使工作人员更好地理解这些问题，并寻求可能的解决措

施。

CFTC Staff Releases Request for Comment on the Impact of Affiliations of

Certain CFTC-Regulated Entities（2023/6/28）

Staff of the Divisions of Market Oversight, Clearing and Risk and Market

Participants today issued a request for comment to better inform them of potential issues

that may arise because of affiliations of CFTC-registered entities with market

participants.

The request specifically asks about affiliations between derivatives clearing

organizations (DCOs), designated contract markets (DCMs), or swap execution

facilities (SEFs) with intermediaries, such as futures commission merchants (FCMs),

or other market participants. Under the Commodity Exchange Act and CFTC

regulations, DCOs, DCMs, and SEFs have responsibilities for supervising their
participants. An affiliation with an intermediary or other market participant raises
