美国商品期货交易委员会（CFTC）市场监管部（DMO）发布了一封不行动
函，延长了 CFTC 在第 22-05 号工作人员信函中做出的关于 CFTC 联邦法规第 45
部分项下的某些互换交易报告要求的不行动立场。该不行动函适用于通过衍生品
清算机构（DCOs）清算互换交易的对手方，但该 DCO 的运作需符合 CFTC 发
布的豁免令（exemptive order）或 CFTC 清算与风险部发布的不行动函中的要求。

CFTC Staff Issues No-Action Letter Regarding Certain Swap Reporting
Obligations for Counterparties Clearing Swaps Through DCOs Acting
Consistent with Exemptive Orders or No Action Letters (2022/12/2)
The Commodity Futures Trading Commission’s Division of Market Oversight
(DMO) today issued a no-action letter extending the no-action position in CFTC Staff
Letter No. 22-05 concerning certain swap reporting requirements of Part 45 of CFTC
regulations. The letter applies to counterparties clearing swaps through derivatives
clearing organizations (DCOs) operating consistent with a CFTC issued exemptive
order or a no-action letter issued by the CFTC’s Division of Clearing and Risk (Relief
DCOs).
The letter states that DMO will not recommend the Commission take an
enforcement action against the counterparties clearing swaps through Relief DCOs for
failure to comply with certain Part 45 reporting obligations until the earlier of: (a)
December 2, 2025; (b) the revocation or expiration of the exemptive order or
