4. 欧盟证券与市场管理局就中央对手方参与要求公开征求意见（2025 年 10 月
9 日）
欧盟证券与市场管理局（ESMA，欧盟证券市场的监管者）宣布，就中央对
手方（CCPs）在确定参与要求时应考虑要素的监管技术标准（RTS）草案公开征
求意见。
ESMA 鼓励利益相关方就中央对手方在以下场景中应考虑的要素发表见解：
制定准入标准时
评估作为清算会员的非金融机构交易对手方满足保证金的能力要求及
承担违约风险准备金的能力时
ESMA 向所有利益相关方就此征求意见并邀请提供反馈，尤其希望听取中央
对手方及其直接或间接参与者（含潜在参与者）、金融机构交易对手方与非金融
机构交易对手方的专业意见。
下一步
本次征求意见的反馈截止期为 2026 年 1 月 5 日。
ESMA 将根据收到的反馈意见撰写最终报告，并于 2026 年第一季度末前向
欧盟委员会提交监管技术标准最终草案。

The European Securities and Markets Authority (ESMA), the EU’s financial
markets regulator and supervisor, has launched today a public consultation on draft
Regulatory Technical Standards (RTS) on the elements to be considered when central
counterparties (CCPs) define participation requirements.
