14. 欧洲证券与市场管理局就市场中断指南公开征求意见（2022 年 9 月 26 日）

欧洲证券与市场管理局（ESMA，欧盟证券市场的监管者）就各成员国监管
机构（NCA）应如何确保交易场所在市场中断的情形下具备适合的通信协议公

开征求意见。

该征求意见稿旨在征求市场参与者对其指南草案的反馈，特别是对以下内容

的反馈：

 交易场所应具备适合的通信协议，以确保在中断期间与会员、市场参与

者和公众保持联系；

 各成员国监管机构应要求交易场所具备预案以避免因市场中断而影响收

市竞价交易（closing auction）；以及

 各成员国监管机构应要求交易场所在发生市场中断导致交易场所无法进

行收市竞价交易的情况下，确保向市场提供官方收盘价。

ESMA 打算以意见的形式发布该指南，该指南将适用于股票市场；如适用，

可适用于非股票工具。

14. ESMA Consults on Guidance on Market Outages (2022/9/26)

The European Securities and Markets Authority (ESMA), the EU’s securities

markets regulator, consults on how National Competent Authorities (NCA) should

ensure that trading venues have appropriate communication protocols in case of a

market outage.

The consultation paper seeks feedback from market participants on its proposed

guidance, and in particular on the proposals that:

 trading venues should have appropriate communication protocols in place
ensuring communication to members, participants and the public during an

outage;
